We´ve been quite dissatisfied with the employee and we´d love to reduce his pay as his performance is by far good enough. Could you explain me the instruments in the legislation which do not lead to termination of the employment contract but such as binding to the reduction of remuneration paid out?
Answer:
I think that reduction of salary due to unsatisfactory work results is nothing but easy. The employer can not simply say the employee of having bad work results and reduce the salary to the desired level. It strongly depends on whether such clause has been implemented into employment contract which was signed in the past by both parties. If so-called performance clause appealing to results is there, then, there´s no contractual obstacle but not having any article you simply can not measure and specify unsatisfactory results and charge penalties….
The second option might resist in penalization of objective breaches in the contract and especialy in the Labour code. If poor work results are in the evident relation to breaches in the contract (for example work hours use failure, break longer than allowed…..) then there´s time to impose sanctions in terms of Labour code application which gives measures how to penalize the employee.
Unlike those employees who evidently keep work hours, stay by the time ….if their results seem unsatifactory you can not simply impose penalties …for such situation you need to have detailed specification in internal directive describing unsatisfactory results upon which you can lean the penalty….
